Rewards Terms & Conditions

In this Agreement ("Agreement"), "you" and "your" refer to each customer ("Customer") and "we", "us" and "our" refer to Sound Concepts (?Sound Concepts?). This Agreement explains our obligations to you, and your obligations to us in relation to the Sound Concepts Rewards Program you are subscribing to. By subscribing to the Sound Concepts Rewards Program, you agree to establish an account with us for such services. When you use your account to purchase or otherwise acquire access to additional Sound Concepts products, or to modify or cancel your Sound Concepts Rewards subscription (even if we were not notified of such authorization), this Agreement as amended covers any such service or actions. Any acceptance of your subscription or requests for our products and the benefits of the Program will occur at our offices in Orem, Utah, the location of our principal places of business.

All benefits that we offer in the Sound Concepts Rewards Program are conditioned upon your compliance with these Terms and Conditions, and all other applicable rules and regulations. These rules are subject to change at any time. Unless otherwise stated, the current rules in effect at the time of your transaction will govern that transaction. Current versions of these Terms and Conditions, and other applicable rules that may apply to your subscription, are available at our website or from a Sound Concepts representative. Please check back frequently for program updates or rule changes.

SOUND CONCEPTS REWARDS PROGRAM: You hereby agree to subscribe to the Sound Concepts Rewards Program by paying an annual membership fee of $34.95. This fee is non-refundable. Thereafter, each of your purchases qualifies you for Sound Concepts Rewards Points. Ten Percent of the dollar amount of each qualified purchase, excluding the cost of shipping and applicable taxes, is converted to Sound Concepts Rewards Points and redeemable, subject to these Terms and Conditions, toward future purchases on a one point to one-dollar basis. You must have enough points in your account to cover the entire cost of any one individual line item in order to redeem points for that line item. For example, an initial purchase of $30 of product would qualify you for 3 Sound Concepts Rewards Points which converts to $3 toward a future purchase. If the total of the line item was $4.00 you will not be able to redeem your points for that line item. If the total of the line item was $2.00 you could redeem 2 of your 3 Sound Concepts Rewards Points for that line item. Sound Concepts Rewards Points are not credited to your account until thirty (30) days after shipment of the purchase that resulted in the award of Points. After the Sound Concepts Rewards Points are added to your account they may be used as credit toward product purchases only. Please note that, unless you renew your annual membership, all Sound Concepts Rewards Points must be used prior to the expiration date of your annual membership or they will be lost. If you choose to renew your annual membership, you will have three (3) months from the anniversary date in which to use the previous year?s Sound Concepts Rewards Points. After three (3) months from the anniversary date your previous year?s points will expire.

Sound Concepts Rewards Points are non-transferable. There is no cash value for Sound Concepts Rewards Points. There is only value in form of a credit applicable toward the purchase of future product through the redemption of Sound Concepts Rewards Points. Sound Concepts Rewards Points cannot be applied toward Taxes or Shipping costs applicable to the purchase. Shipping will be calculated on the full value of the order before Points redemption. Sound Concepts Rewards Points are not awarded for purchases made through the redemption of Sound Concepts Rewards Points. There will be no refund on the purchase of items where Sound Concepts Rewards Points were redeemed to accomplish said purchase. Not all of our products are available for purchase through Sound Concepts Rewards point redemption. Sound Concepts Rewards points may not be redeemed in conjunction with any other promotion including special offers and/or promo codes. Please note that Points calculation and redemption under the Sound Concepts Rewards Program does NOT apply to customized orders. For a full list of applicable products please visit our website.

We reserve the right to terminate your membership in the Sound Concepts Rewards program at any time if you violate these Terms or Conditions or any other rules and regulations that apply to your account. Termination of your membership will result in a loss of all accumulated Sound Concepts Rewards Points in your account and the loss of all other Sound Concepts Rewards benefits. Terminated members are not eligible to participate in any aspect of the Sound Concepts Rewards Program. In lieu of termination, we may at our sole discretion deduct Sound Concepts Rewards Points from your account, but permit you to continue participating in the Sound Concepts Rewards Program. Those whose accounts have been terminated for any reason may not reopen new accounts. It is your responsibility to familiarize yourself with the Sound Concepts Rewards Program rules and with the other terms and conditions that apply to your account. We reserve the right to change program rules, benefits, regulations, fees, Points Award guidelines, and special offers at any time without notice. Such changes to our Sound Concepts Rewards Program may include modifications that (i) govern Points or other benefits earned on or after the date of change, (ii) change the value of already accumulated Points or other benefits or (iii) govern Points or other benefits earned on or after the date of change and change the value of already accumulated Points. We reserve the right to terminate the Sound Concepts Rewards Program with six months' notice. Unless otherwise stated, the terms and conditions of the Sound Concepts Rewards Program in effect at the time of your purchase, request for benefit, or other transaction will govern the transaction.

The sale or barter of Sound Concepts Rewards Points by Sound Concepts Rewards members is prohibited. We will terminate or deduct Points from the account of any member who violates this rule. Purchases made through prohibited sale or barter transactions are VOID, and will be rejected. Persons trying to use such Points for purchases will not be permitted to do so unless they purchase the product at the applicable full price.

Sound Concepts Rewards Points will be credited to your Sound Concepts Rewards account, regardless of who pays for the purchase. Sound Concepts Rewards Points from one account cannot be pooled or combined with the Points of another individual?s account. Each member must earn his/her own Points. Sound Concepts Rewards Points awarded and applied to your account cannot be transferred once recorded. Attempts to obtain Points in the Sound Concepts Rewards Program as a result of a purchase for which you have already received Points is prohibited.

To ensure redemption of your Points toward a purchase, please be sure to log into your account using the same email address you used to sign up with Sound Concepts Rewards. Failure to do so may result in Sound Concepts Rewards Points not being credited toward your account. We will not be held responsible for users you do not log in to their account or log in to a previously created or erroneous account. The email given at the time of purchase must match the email on the Sound Concepts Rewards Account for Points to be credited.

We are the final authority on qualification for Points accumulation and reserve the right to deduct Points from your account at any time if Points were credited in error.

You are responsible for verifying that Points for qualifying purchases are credited to your account. All account discrepancies must be reported in writing within six months of date of purchase. We are not responsible for the delivery of incoming correspondence. Verbal notification is not accepted. You should maintain copies of receipts for your records until proper credit appears in your Sound Concepts Rewards Account. If Points for a qualifying Sound Concepts purchase are not credited to your account within 90 days, please send written inquiry to:

MISCELLANEOUS: YOU AGREE THAT OUR ENTIRE LIABILITY, AND YOUR EXCLUSIVE REMEDY, IN LAW, IN EQUITY, OR OTHERWISE, WITH RESPECT TO THE BENEFITS PROVIDED UNDER THIS AGREEMENT AND/OR FOR ANY BREACH OF THIS AGREEMENT IS SOLELY LIMITED TO THE AMOUNT YOU PAID FOR SAID BENEFIT(S) DURING THE TERM OF THIS AGREEMENT. IN NO EVENT SHALL SOUND CONCEPTS, INC., ITS LICENSORS AND CONTRACTORS (INCLUDING, BUT NOT LIMITED TO, THIRD PARTIES PROVIDING SERVICES AS PART OF THE SUBSCRIPTION SERVICE) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT THAT A STATE DOES NOT PERMIT THE EXCLUSION OR LIMITATION OF LIABILITY AS SET FORTH HEREIN OUR LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW IN SUCH STATES. YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT OR ANY OF OUR SERVICES MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR SUCH CLAIM SHALL BE FOREVER BARRED.

You and Sound Concepts agree that this Agreement and any disputes hereunder shall be governed in all respects by and construed in accordance with the laws of the State of Utah, United States of America. You and we each agree to submit to exclusive subject matter jurisdiction, personal jurisdiction and venue of the United States District Court for the District of Utah, for any disputes under, arising out of, or related in any way to this Agreement (whether or not such disputes also involve other parties in addition to you and us). If there is no jurisdiction in the United States District Court for the State of Utah, for any such disputes, you and we agree that exclusive jurisdiction and venue shall be in the courts of Utah County, Utah. You agree that the terms of this Agreement are severable. If any term or provision is declared invalid or unenforceable, in whole or in part, that term or provision will not affect the remainder of this Agreement; this Agreement will be deemed amended to the extent necessary to make this Agreement enforceable, valid and, to the maximum extent possible consistent with applicable law, consistent with the original intentions of the parties; and the remaining terms and provisions will remain in full force and effect.

You agree that this Agreement is the entire, complete and exclusive agreement between you and us regarding the Sound Concepts Rewards Program and supersede all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of this Agreement.
